About the Job

The UK is one of the International Maritime Organization’s (IMO) Member States and a signatory to international maritime conventions. The UK Member State comprises the UK, its Crown Dependencies (CDs) and Overseas Territories (OTs) who have British Shipping Registers and is collectively known as Red Ensign Group (REG). Under the UN Convention on the Law of the Sea the UK has devolved implementation of the duties, obligations and responsibilities for flag, port and coastal State to the individual respective REG members. The Maritime and Coastguard Agency (MCA), on behalf of the UK Secretary of State, is responsible for implementing those international conventions to which it is a party in the UK and for ensuring that all other REG jurisdictions accomplish the same for those the international conventions which have been extended to them
Montserrat recognises the need to comply with its international obligations including those flag, port and coastal State duties in the IMO Instruments Implementation Code (III Code), and that the responsibility for meeting those obligations lies across a number of service areas. Montserrat Port Authority chairs the Montserrat Maritime Administration, which is in the process of developing a coordinating body to act on its behalf in maintaining oversight of the Montserrat III Code implementation strategy.
Job Purpose
The Maritime Policy Advisor/Compliance Officer (MPACO) will be required to provide a leadership role within Montserrat. They must ensure that all systems and processes required to adhere to international maritime obligations are in place and to the standard required to satisfy the obligations. In addition, the MPACO will provide a supporting role to other Montserrat officials in the design and delivery of the desired systems and processes where necessary. To this end, the MPACO will coordinate and support the existing Montserrat departments in achieving maritime compliance in their expert areas as well as developing areas for which there is currently no capacity or designated personnel within Montserrat. The MPACO will have relevant maritime experience and will also have a project management background with strong written and verbal communication skills, including the ability to maintain a realistic balance among multiple priorities and build relationships with the local community to promote understanding for potential change and provide an evidence based information system to decision making and the
justification thereof. The MPACO will have the ability to work independently on this project, from conception to completion, and be able to work under pressure to meet deadlines.
The overall aims and objectives of the post are:
? To provide support and advice to the Maritime Administration and key stakeholders in developing strategies and practical implementation measures to assist in reaching compliance with the III Code while also ensuring continued future compliance as changes to existing international conventions occur or as new conventions are adopted by IMO
? Ensure maritime compliance requirements and strategies are appropriately communicated within government and that appropriate domestic legislative arrangements are in place.
? Manage the Montserrat Ship Register in accordance with legislative requirements.
? Enhance awareness and cooperation between Montserrat Port Authority and respective service areas within the Government to develop a collaborative approach to demonstrate compliance.
? Achieve, maintain and improve overall performance and capability as a flag, port, and coastal State by continuous monitoring, review and evaluation.
? Seek to identify and eliminate causes of actual and potential non-compliance by monitoring and providing recommendations to the relevant service area.
? Effectively demonstrate how compliance is achieved in accordance with the requirements of the III Code.
? Monitoring of changes to IMO conventions.
? Recommend methods of implementation and enforcement of policies through issuing of legislation, procedures and guidance, and ensure they are kept current.
? Promote the requirements of the III Code and collect feedback from the relevant stakeholders on how international obligations are being achieved or otherwise.
? Provide recommendations and support on methods of achievement/ enforcement.
? Work with Montserrat departments and stakeholders to develop maritime policy and procedures to address the gaps identified in the gap analysis and recommendation documents.
? Create and/or take part in opportunities to maintain and develop relationships with all relevant stakeholders within the UK, OTs and CDs, to continue a collaborative working approach.
Key tasks
The key tasks of the MPACO are to: -
1. Develop and maintain an III Code strategy, which aligns with REG guidance, for Montserrat.
2. Establish a methodology to monitor international maritime standards and obligations and provide guidance and/or recommendations on their appropriateness for Montserrat.
3. Develop and manage the Montserrat Ship Register.
4. Implement and maintain a monitoring programme to continuously check the adequacy of the measures being taken to give effect to relevant international conventions.
5. Identify areas of non-compliance, potential non-compliance, and/or improvement.
6. Support Montserrat departments to develop and update maritime policies, procedures, legislation and guidance to deliver effective compliance and build capacity in their areas of expertise.
7. Support Montserrat departments and relevant stakeholders to achieve and maintain effective ability to implement and enforce relevant international instruments.
8. Work with relevant service areas to support specific work, regulation and policy development covering areas including:
? General maritime administration and data management
? Marine environment protection
? Maritime education & training
? Maritime legislation
? Maritime safety and security
? Navigation & communication
9. Work with relevant service areas to support specific work streams including; defining and documenting responsibilities, authorities, qualifications and continuous training of personnel who manage and perform work relating to and affecting safety and pollution prevention.
10. Recommending resources and processes capable of administering a system of safety and environmental protection to the relevant service areas.
11. Engage with sea users, local stakeholders and businesses to improve understanding, change behaviour and develop a culture of compliance.
Working hours
Working hours will be thirty-five (35) hours per week (combination of remote working and on site) however the post holder will be expected to regularly work outside of perceived normal work hours to coincide with maritime environment usage and shipping schedules.

Selection Process
